European Decisions: Article 53 Certificate (Outbound) & Enforcement in Cyprus (Inbound)

What is the Article 53 Certificate (and why it is “key”)
The Article 53 Certificate is issued by the court of origin and uses the form set out in Annex I of Regulation 1215/2012.
For the purpose of enforcement in another Member State, the framework provides that the applicant must submit to the competent enforcement authorities:
- a copy of the judgment, and
- the certificate issued pursuant to Article 53.
A) Outbound: Issuance of Article 53 Certificate from Cyprus to other Member States
If you have a Cypriot court judgment and wish to enforce it, for example, in Greece, Germany, Italy, France, etc., we undertake the issuance of the Article 53 Certificate from the competent court in Cyprus.
Steps (Outbound) – how we handle it
1) Eligibility & scope assessment
We confirm that the judgment concerns a civil/commercial matter and falls within the scope of Regulation 1215/2012.
2) Preparation of file for the court of origin (Cyprus)
We organize the judgment file (and all necessary documents) so it is ready for the certificate application.
3) Application and issuance of the Article 53 Certificate (Annex I)
We file the application with the court of origin for the certificate to be issued in the Annex I format.
4) Translations / formal requirements for the state of enforcement
Where required, we arrange translations so the file is ready for use in the enforcement state.
5) Coordination with local counsel (if required) & initiation of enforcement abroad
Depending on the country, we coordinate next steps with partners/local lawyers so enforcement can begin immediately.
6) Protective measures
If the defendant attempts to dispose of or transfer assets to third parties, or take steps to avoid enforcement, we can obtain interim measures preventing such actions.
B) Inbound: Enforcement of a European Judgment in Cyprus (from another Member State)
If you have a judgment from a court of an EU Member State and the debtor has assets/activity in Cyprus, we undertake the entire enforcement process in Cyprus.

Steps (Inbound) – how we handle it
1) Initial assessment & strategy selection
We review the judgment data, the amount of the debt (principal/interest/costs), and map out the best enforcement route in Cyprus.
2) File preparation, translations, and compliance with formal requirements
We ensure the document package is complete and suitable for enforcement actions.
3) Initiation of enforcement in Cyprus & selection of measures
We proceed with enforcement actions in Cyprus, in accordance with Cypriot procedure (measures depend on the type/location of assets).
4) Handling debtor reactions & continuation until recovery
If objections/delays arise, we address them promptly to protect the creditor’s position and complete enforcement.
Indicative Case Example (Case Study)
At Diogenous Law, we have handled similar cases. Indicatively, in a case involving the registration of a Cypriot court judgment in Greece, we successfully issued the relevant certificate under Article 53 of Regulation 1215/2012.
The certificate included details of the case, which concerned dishonoured cheques and breach of agreement, including a monetary claim of €130,000, with statutory interest applied over different periods at varying rates (4%, 3.5%, 2%, 2.5%, 5.5%, and 6% until repayment), as well as €20,050 in costs, with provision for interest on part of the costs amount.
